Donald Trump Cannot Be Withheld from State Ballots Supreme Court Rules

Donald Trump won a major victory from the United States Supreme Court!



The U.S. Supreme Court gave former President Donald Trump a resounding victory on Monday, ruling unanimously that states cannot exclude him or any other federal candidate from the ballot under a rarely invoked constitutional clause that forbids those who “engaged in insurrection” from holding public office.

The 9-0 ruling is the first in the court’s history on the insurrection clause in the 14th Amendment to the U.S. Constitution. Section 3 of the amendment.

The Supreme Court decision on Monday reversed a Colorado Supreme Court decision holding that Trump was ineligible to serve as president due to his violations of the 14th Amendment’s Section 3 (the insurrection clause).



Dozens of states had pushed to keep the former president off their ballots, but this decision shuts them down.

“We conclude that states may disqualify persons holding or attempting to hold state office,” the justices wrote. “But states have no power under the Constitution to enforce Section 3 with respect to federal offices, especially the presidency.”

“Because the Constitution makes Congress, rather than the states, responsible for enforcing section 3 against all federal officeholders and candidates, we reverse,” the ruling said.
